Misclassification by trade. The worker performs carpenter work, but the contractor lists them as "laborer" on certified payroll. Laborer rates are lower than skilled trade rates. In our experience, this is the single most common form of prevailing wage underpayment in New Jersey.

Hours misreporting. Certified payroll shows 40 hours worked. Actual hours were 50, including 10 hours of overtime. The 10 hours either go unpaid or get paid at straight time instead of the required 1.5x rate.

Fringe benefit underpayment. Hourly rates include a separate fringe benefit component. Contractors may fail to pay it, pay it at less than the determined rate, or improperly credit existing benefits like routine health insurance toward it.

Cash payments off-books. The contractor reports the hours reflected on the certified payroll records, but additional hours may be paid separately at a lower rate. On paper, the records appear compliant. But the worker's total compensation is different.&nbsp;

Apprentice rate abuse. The contractor pays a worker the apprentice rate without enrolling them in a registered apprenticeship program. A "trainee" or "intern" label isn't a substitute.

Per diem and travel time games. Compensable time spent traveling between job sites, on-call requirements, split shifts, or specific off-the-clock work gets excluded from the payroll.

Improper deductions. In some cases, workers see withholdings for items such as tools, uniforms, training expenses, or administrative fees that affect the amount they ultimately receive.&nbsp;

Who authorized the deductions. Decision-making matters. Repeated cuts approved by supervisors or senior management carry more weight than a clerical mistake. Consistent approval suggests the decision was intentional rather than the result of a payroll mistake.

Whether the employer maintained a written policy. Employers aren’t always penalized for every mistake. Federal regulations provide protections for employers that maintain clear policies, offer a complaint process, reimburse employees when problems are identified, and take corrective action.&nbsp;

What happened after complaints were made. Employers receive less benefit from the safe-harbor protections when they continue the same payroll practices after learning of potential problems. Ongoing conduct after receiving notice weakens the employer's defense.&nbsp;

Employees may discover years later that their pay was calculated differently from coworkers. Federal regulations require a clear understanding of the arrangement. Unexpected changes rarely support the employer’s argument.&nbsp;
